Govt Moves to Legally Establish National Investigation Department Under Prime Minister’s Office

Jul 03, Kathmandu - The Government of Nepal has initiated the process to amend the Nepal Special Service Act, 2042, to provide a legal basis for placing the National Investigation Department (Intelligence Agency) under the Prime Minister and the Council of Ministers' Office.

Previously, the department was transferred from the Ministry of Home Affairs to the Prime Minister’s Office through the Administrative Distribution Regulations, 2083. Now, with the proposed amendment, the government aims to enshrine this arrangement into law, ensuring its permanent legal recognition.

Historically, Nepal’s administrative practices have seen the National Investigation Department frequently shift between the Ministry of Home Affairs and the Prime Minister’s Office. During the tenure of former Prime Minister K.P. Sharma Oli in 2075, the department was brought under the Prime Minister’s Office via amendments to the Nepal Act. Before that, it operated under the Ministry of Home Affairs. The interim government later returned the department to the Ministry of Home Affairs.

Subsequently, the arrangement was again made through the Administrative Distribution Regulations, 2083, placing the department under the Prime Minister’s Office. The proposed legislative amendment aims to formalize this arrangement in law.

If the bill is passed in Parliament, it will clearly establish the National Investigation Department’s status as an entity under the Prime Minister’s Office in legal terms.
