Jun 19, Kathmandu - Kathmandu District Court has overturned the organized crime charges filed against Rabi Lamichhane, the leader of the Rastriya Swatantra Party (RSP). The bench led by Judge Atmadev Joshi approved the withdrawal of charges related to organized crime in connection with the Golden Laxmi Cooperative fraud case.
However, the court upheld the charges of cooperative fraud against Lamichhane. During the amendment of the charges, the court emphasized the importance of providing restitution to the victims. The order noted that the amendment was made considering the court’s custodial duties and the principles of justice.
The court stated, “In the context where the Act recognizes the concept of victim-oriented justice, lengthy criminal proceedings, severe charges, and reconciliation can hinder justice for victims. Therefore, the court must exercise its custodial responsibilities to balance the interests of justice, the independence of prosecution, victims' rights, and public interest.”
The Kathmandu Office of the Attorney General submitted a petition for the amendment of the charges, leading to today’s hearing.
Earlier, similar withdrawals of organized crime and asset laundering charges against Lamichhane were made by the Kaski and Parsa District Courts.
