High Court of Patan Issues Temporary Ban on Screening of Nepali Film 'Lalibazar'

Apr 28, Kathmandu - The High Court of Patan has issued a temporary injunction preventing the screening of the Nepali film 'Lalibazar.'

On Tuesday, a bench led by Justice Prakash Dhungana ordered that the film not be publicly exhibited until further notice. The court's decision was based on a writ petition filed by Roshan Nepali, who argued that the film portrays the community in a negative light and promotes discrimination.

The court stated, “Considering the potential for irreparable harm to the petitioner and balancing the interests involved, a temporary injunction has been issued to halt the public screening of the film ‘Lalibazar’ until Baishakh 22.”

Nepali's petition contended that the film damages the dignity, respect, and self-esteem of specific communities, especially women, and spreads hate and divisiveness. The court has asked the opposition to submit a written response within 15 days and has scheduled a hearing for Baishakh 22.

The court based its decision on a previous ruling by the Supreme Court made seven years ago, which restricted the screening of certain movies and publications that could harm community sentiments. The 2018 Supreme Court ruling emphasized protecting the dignity and respect of all communities and individuals from hate speech and divisive content.

The petitioner argued that the film 'Lalibazar,' scheduled for release on Baishakh 18, poses a serious threat to community harmony and individual dignity. The film was recently approved by the censor board.

The court's order reflects the importance of safeguarding fundamental rights and community sentiments, especially regarding women’s dignity and respect, as enshrined in the Constitution of Nepal.
